communicate our vision for Iraq. Mercy Corps has provided critical assistance
in Iraq to some of the country’s most vulnerable populations during a period
of tremendous upheaval. We are now searching for an experienced professional
to elevate our contract management system to ensure appropriate compliance
across the country office.
To ensure the efficient, systematic, effective monitoring of contracts;
development of transparent tendering schedules and good record keeping;
providing advice on best methods of contract design; developing best practice;
advising and developing strategy, policy and procedure in relation to these
functions in the context of all Mercy Corps services; and to contribute
towards the successful operation of the Operations Team.
Under the management and direction of the Procurement Manager, the Contract
Management Officer:
* Plans and manages all contractual aspects; establishes and maintains work programme and schedules for on-going contracts and newly planned ones.
* Supports the development and implementation of operational plans, standard operating procedures (SOPs), initiatives and projects relating to contract compliance and performance management.
* Create and maintain relationships with MCIQ team members to serve as the singular point of contact for matters concerning contracts.
* Supports the contracting process including providing input to statement of works/requirements (including articulation of performance standards and Key Performance Indicators, assists in the development of technical evaluation criteria, and provides guidance during contract drafting.
* Develops a quality assurance plan to provide a systematic method to monitor contract performance.
* Participates in the development of contract risk assessments and risk management plans, including mitigating measures.
* Develops contract compliance checklists and implementation plans.
* Maintain contract database and share follow ups for contracts that are about to expire and work on contract close out plan with Originating department.
* Participates in the assessment of contractor performance, including advice and action to address instances of poor performance and/or non-compliance with contractual obligations.
* Initiates contract close outs including identifying, documenting and disseminating best practices and lessons learned and securing the final contractor performance assessment.
* Supports, in partnership with other teams, the enforcement of Mercy Corps contracts in consultation with the Mission, Procurement and headquarters stakeholders, as appropriate. Liaises with other departments, including the Procurement, in relation to claims and disputes, demanding specific performance, claiming against warranties, and other contractual remedies.
* Within the terms and conditions of the contract, works towards resolution of conflicts or performance issues arising in cases of poor performance and/or non-compliance with contractual obligations.
* Participates in the development of contract risk assessments and risk management plans, including mitigating measures.
* Initiates contract close outs including identifying, documents and secures the final contractor performance assessment.
* Identifies and recommends areas of operational improvement, informs on policy, procedures, disseminates best practices and lessons learned.
* Within the terms and conditions of the contract, works towards resolution of conflicts or performance issues arising in cases of poor performance and/or non-compliance with contractual obligations.
* Drafts relevant audit responses on contract management related issues, as required.
* Maintains electronic and hardcopy files and records to ensure proper accountability.
* Ensures relevant budget inputs and Procurement planning, when required.
* Collaborate with the Ethics team to ensure that any greylisted vendor contracts are temporarily or permanently suspended depending on the final management decision; collaborate with the Ethics team to ensure the same where a vendor suspension is to be lifted, and ensure adequate proof is documented and attached to the vendor’s contract.
* Collaborate with the Procurement team to ensure that any greylisted vendors are formally notified of the decision as per internal policy requirements.
* Performs other related duties as required.
TRAINING AND CAPACITY BUILDING
* Develop and implement the Contract Management Training plan for all Mercy Corps Iraq team members.
* Coordinate the identification of technical assistance needs of partner organizations and capacity strengthening and required interventions to support compliance.
* Help identify, assess and strengthen partnerships relevant to contract management, applying appropriate application of partnership concepts, tools and approaches.
Reports Directly To: Procurement Manager
Works Directly With: Operations Team, Ethics Team, Program Leadership
Team, Grants and Compliance Team, PAQ, Finance and HR Teams.#### Knowledge and Experience
* Bachelor’s degree in Business Economics or related field.
* Experience and Technical Competencies: (include years of experience):
* A minimum of 2 years of progressively responsible experience in providing project / contracts management support with an INGO or a comparable international organization is required.
* Supply Experience in procurement and / or contract management for Property, Soft and Hard Services in Facility Management is highly desirable.
* An appreciation of the basic concepts of risk management in an operational environment.
* Ability to interact at different levels in and outside the organization, keep good relationships and influence senior level staff and customers.
* Knowledge of accounting, budgeting, and automated financial and accounting reporting systems.
* Excellent written and verbal English communication skills.
* Proactive, independent work approach and a high attention to detail and accuracy.
* Highly developed skills and demonstrated capacity developing accountability strategies and mechanisms, including implementation and training in accountability principles and practice.
* Advanced knowledge and demonstrated ability of principles and practices related to confidentiality, protection, and interviewing of extremely vulnerable individuals in a humanitarian context;
* Demonstrated capacity to work collaboratively in a multi-cultural environment with competing priorities, tight deadlines, and in a complex emergency context;
